WASHINGTON, D.C. – Senator John Barrasso (R-Wyo.) released the following statement after President Obama nominated Solicitor General Elena Kagan to serve as Associate Justice of the U.S. Supreme Court:
“The Senate will give Ms. Kagan a fair confirmation process. It is crucial that we have time to thoroughly examine her record. Every American has a right to know about a nominee’s experience and the standard they will apply in judging future cases.
“In light of the recently passed health care legislation, I look forward to speaking with Ms. Kagan about the constitutionality of the new health insurance mandate. Her response will shine a light on her fundamental judicial interpretation of the Constitution.
“We need a Justice who is impartial, and will allow the facts and Constitution to speak. It is a Justice’s responsibility to apply the law, not to write it.”
